Business Terms & Conditions

1. About HospoMatch

HospoMatch is a hospitality recruitment platform operated by Ebushi Pty Ltd (ABN 50 620 161 462), trading as HospoMatch ("we", "us", "our"). By registering a business account, you ("the Business", "you") agree to these Terms & Conditions in full.

2. Platform Access & Plans

HospoMatch offers tiered subscription plans (Free, Starter, Pro). Access to features is determined by your active plan. We reserve the right to modify plan features, pricing, and availability with 30 days' notice. Continued use after changes constitutes acceptance.

3. Resume Uploads & Data Ownership

This is a critical clause. Please read carefully.

• When you upload a candidate's resume to HospoMatch — whether via bulk upload, manual entry, or QR poster submission — you confirm that you have a lawful basis under the Australian Privacy Act 1988 (Cth) to share that individual's personal data with a third-party platform.
• Upon upload, the resume and all extracted candidate data becomes the property of Ebushi Pty Ltd (ABN 50 620 161 462) trading as HospoMatch, and forms part of the HospoMatch candidate database.
• You may continue to access and action that candidate's profile through your business dashboard. However, HospoMatch retains the right to match that candidate with other registered businesses in accordance with the worker's consent and these Terms.
• You must not upload resumes of individuals who have not consented to their data being stored digitally or shared with third parties. By uploading, you represent and warrant that such consent exists.

4. Candidate Privacy Obligations

As a registered business on HospoMatch, you agree to:

• Use candidate data only for the purpose of assessing suitability for employment.
• Not share, export, or sell candidate data to any third party outside of your own hiring process.
• Comply with the Australian Privacy Act 1988 and Australian Privacy Principles (APPs) in all dealings with candidate data.
• Not contact candidates through channels outside of those facilitated by HospoMatch unless you have independently obtained their consent.

5. Credits & Payments

• Credits are non-refundable once used.
• Subscription payments are billed in advance and are non-refundable except as required by Australian Consumer Law.
• Credits earned through the platform (e.g. via resume uploads) have no cash value and cannot be transferred.
• HospoMatch reserves the right to adjust credit values and subscription pricing with 30 days' notice.

6. QR Code Recruitment

HospoMatch provides QR code posters for use at your venue. By displaying these posters:

• You authorise HospoMatch to collect candidate applications on your behalf.
• Candidates who apply via your QR code are entering HospoMatch's platform and are subject to the Worker Terms & Conditions.
• You acknowledge that candidates who apply via your QR code may also be matched with other businesses on the platform.

7. Prohibited Use

You must not use HospoMatch to:

• Post roles that are fictitious, misleading, or intended to harvest candidate data without genuine hiring intent.
• Discriminate against candidates on the basis of age, gender, race, nationality, religion, disability, or any other protected characteristic under Australian law.
• Scrape, copy, or export the HospoMatch candidate database for use outside the platform.
• Attempt to circumvent the platform to directly source candidates without paying applicable fees.

8. Intellectual Property

All platform technology, branding, design, and algorithms are the exclusive property of Ebushi Pty Ltd (ABN 50 620 161 462). You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose. You acquire no intellectual property rights by using HospoMatch.

9. Termination

HospoMatch may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or misuse the platform. Upon termination, your access to candidate data will be revoked. Ebushi Pty Ltd (ABN 50 620 161 462) retains all candidate data as part of its proprietary database.

10. Limitation of Liability

To the maximum extent permitted by Australian law, Ebushi Pty Ltd (ABN 50 620 161 462) is not liable for any indirect, incidental, or consequential loss arising from use of the platform, including failure to hire, data inaccuracies, or platform downtime. Our total liability in any matter is limited to the amount you paid to us in the 12 months prior to the claim.

11. Governing Law

These Terms are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
